Smoking ban fines
Posted: 23 Jul 07 4:36 PM Modified By Sarah_Ireland on 7/25/2007 9:57:04 AM)
This week Buddy was asked:  In light of the recent smoking ban that has come into force, if someone is caught smoking in a banned area and the person in charge of the premises fails to stop them, what is the maximum amount they can be fined?

Buddy says: Those in charge of the premises could face a charge of £2500 if they fail to stop somebody smoking on their premises.

Additional Information

Those in charge of premises could also be charged on-the-spot fines of £200 if they fail to display no-smoking signs, with the penalty increasing to £1000 if the issue goes to court.  Not only is the owner of the premises charged, but the smoker could be fined £50, and up to £200 if it goes to court.

Individuals can now be fined for smoking in virtually all 'enclosed' and 'substantially enclosed' public places and workplaces. This includes places like pubs, restaurants, cafes, nightclubs and private members' clubs. You'll still be allowed to smoke indoors, in your home or places considered to be "homes", such as prisons, care homes and hotels, but smoking could still be banned at certain outdoor locations that are "substantially enclosed", such as football grounds and railway platforms.
