Tribunal procedure: Response Form

This week buddy was asked: Unfortunately, we did not enter a Response to a Tribunal claim received and the time limit has now passed. Can costs be awarded against us at the hearing?

Buddy says: There is no obligation on an employer to enter a Response and therefore you have not technically breached any rule by failing to enter a Response so costs should not be awarded against you.

Employer information: Under the Tribunal rules, costs can be awarded against an Employer for failure to enter a Response where the Claimant has to deal with an application by the Respondent for a review of a default judgment (judgment made in favour of the Claimant when an Employer fails to enter a Response).
