Sessionals

We are about to recruit for two new positions and terminate the sessional staff who are currently filling them.  They have been in these posts for about two years and the only reason we do not want to take them on, is because of their poor timekeeping and absence levels (neither have not been addressed, are not symptons of a disability)...I am assuming if we do not take them on we are going to face problems..any thoughts on how we can overcome this and minimise risks?

Buddy says:  Unfortunately, your proposal is not straightforward and carries with it a number of risks, most notably unfair dismissal and possibly less favourable treatment (i.e. on the grounds of fixed term or part time status etc).  Much will depend on the the employment status of these workers as well as the factual background to this matter.   This is a potentially tricky situation and it is recommended that you seek legal advice from a member of the Clarkslegal Employment Team before taking any action.
