This week buddy was asked: is there a legal requirement for public bodies to promote equality of opportunity for disabled people?

Buddy says: Yes, since 4 December 2006 the Disability Equality Duty (DED) came into force requiring public bodies to promote equality of opportunity for disabled people. A Disability Equality Scheme must also be published by certain public bodies.

Additional information: The Disability Discrimination Act 2005 (DDA) stipulated the requirement from 4 December 2006 for public bodies to:

  • Eliminate unlawful disability discrimination and disability-related harassment.
  • Promote equality of opportunity for disabled people.
  • Promote positive attitudes.
  • Encourage disabled people to take part in public life.

Section 49 of the DDA also lists additional duties which many public bodies have to adhere to. These including:

  • The duty to publish a Disability Equality Scheme.
  • The duty to implement a Disability Equality Scheme.
  • Show how they (public bodies) intend to comply with the disability equality duty.

This scheme is similar to the race equality duty which has been in force since 2001 and the gender equality duty which will come into force on 30 April 2007.
