Working time holiday entitlement factsheet

The Regulations
  • Working Time Regulations 1998 ("the WTR") came into force on 1 October 1998 and regulate maximum working hours and rest periods (see Working Time fact sheet). However, they also provided workers with a statutory right to four weeks` paid annual leave.
  • Working Time (Amendment) Regulations 2007 came into force on 1 October 2007 to implement an increase in the minimum holiday entitlement. 
Entitlement to paid holiday
  • With effect from 1 April 2009, every worker is entitled to 5.6 weeks paid leave in each year.  Part time workers are entitled to a pro rata amount of leave.
  • A week`s leave must be the same amount of time as the worker`s working week e.g. if a worker works a 4 day week, he is entitled to 22.4 days` leave for the leave year. However, for workers working more than 5 days a week the amount of statutory leave to which a worker is entitled will be capped at 28 days, although additional leave may be awarded under a contract of employment.
