When does the Data Protection Act apply?
 
Within the workplace, the Data Protection Act 1998 (the DPA) is concerned with information (or data) which an employer collects and keeps on any individual who works for them or who wants to do so or has done so. This covers current and former job applicants, current and former employees, agency staff and casual staff. It can also cover others such as volunteers and work experience students.
 
What information does it cover?
 
(Note that there are some additional provisions relating to health records, educational records and some public records held by public authorities)
 
Not all information about these people falls within the DPA.  The DPA specifies that it only applies to "Personal Data".  Personal Data is information which identifies a living individual and affects that individual`s privacy in the sense that the information has the individual as its focus or is otherwise biographical in nature.
