The Employment Act 2002 introduced basic paternity rights for employees and these are set out in the Paternity and Adoption Leave Regulations 2002 and the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations 2002.

The Work and Families Act 2006 enhanced these rights further by creating a new right to Additional Paternity Leave, which is implemented by the Additional Paternity Leave Regulations 2010 and the Additional Statutory Paternity Pay (General) Regulations 2010.

The combined effect of the legislation is that, subject to meeting certain specified criteria, employees now have a right to two periods of non-consecutive paternity leave, Ordinary and Additional.

The right to paternity leave and pay is available in relation to births and adoptions and can be claimed by both men and women depending on the circumstances.
