Since 1 October 2011 Temps provided by Agencies have certain rights. This means you need to ensure that:
(a) You know which Temps are working for you; what jobs they are doing and how long they have been with you;
(b) All Temps have access to certain facilities and information about job vacancies in your business; and
(c) You are able to provide certain information to the Agencies about the pay and working conditions of your employees.
RIGHTS
Access to facilities - All Temps are now entitled by law from the very first shift that they work for you to have access to collective facilities in the same way as your staff do, for example, the staff canteen.
Information relating to job vacancies - All Temps are also entitled as from the very first shift they work for us to have access to information about job vacancies in your business. Temps need to be told where and how to find this information, such as on the intranet.
Pay and Working Conditions - Once a particular Temp has been working with you in the same role for 12 weeks, they become entitled to some of the same terms and conditions of employment that you offer as standard to your employees. The test is what terms and conditions do you offer your employees doing the same job as the Temp or what terms and conditions would you have offered to the Temp if you had recruited them directly.
