Appointing a medical expert checklist

  • Obtain the employee`s written consent for the medical examination and for the release of his medical records to the doctor and/or the company.
  • Select an appropriate expert depending upon the employee`s symptoms, e.g. GP, Orthopaedic Surgeon, Psychiatrist.
  • If the report is being obtained from an expert who has previously treated the employee, advise the employee of his rights under the Access to Medical Reports Act 1988 including his right to see the report in advance, request changes to the report, and withhold consent to the report being supplied to his employer (for further details see ‘letter to employee requesting medical report`).
  • Prepare a letter of instruction to the medical expert setting out the employee`s job duties and how long he has been off sick. Ask questions appropriate to the circumstances. For example:
  • How long is the employee likely to be ill and when should you expect a return to work?
