Smoke-free workplace implications for employers factsheet

The legislation
 
The Health Act 2006 ("the Act") was introduced as part of the Government`s strategy to tackle smoking and its effects on health. The Act aims to:
  • Recognise a person`s right to be protected from the harm of second-hand smoke and to breathe smoke-free air 
  • Help people trying to give up smoking by providing supportive smoke-free environments 
  • Reduce illness from medical conditions caused by second hand smoke 
  • Save lives

In England, the Act came into force on 1 July 2007 when the following supporting regulations also took effect: 

  • The Smoke- free (Premises and Enforcement) Regulations 
  • The Smoke-free (Signs) Regulations
  • The Smoke-free (Exemptions and Vehicles) Regulations 
  • The Smoke-free (Vehicle Operators and Penalty Notices) Regulations 
  • The Smoke-free (Penalties and Discounted Amounts) Regulations
