Adoption leave and pay

The Paternity and Adoption Leave Regulations 2002 (“2002 Regulations”) give an entitlement to adoption leave to qualifying individuals who adopt. Where a couple adopt jointly, only one of the couple will be eligible to benefit from adoption leave and pay, the other partner may be entitled to statutory paternity leave and pay.

There are minimum statutory provisions for pay during adoption leave introduced under the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations 2002.

The general legal principles, including the employees’ statutory rights are outlined in the guidance notes and further guidance is also given on the interpretation of the law and on practical management issues, which may arise, in the other available resources.
