The Employment Act 2002 ("2002 Act") provides certain employees with the right to request flexible working. It is worth noting that employees do not have a right to have the contract of employment varied, only the right to apply for this. The Flexible Working (Eligibility, Complaints and Remedies) Regulations 2002 and the Flexible Working (Procedural Requirements) Regulations 2002 ("the Regulations") which came into force on 6 April 2003, flesh out the provision of the 2002 Act. The Work and Families Act 2006 extends the right to request flexible working under new regulations which came into force on 6th April 2007.
